Terms of Service

 

1. Scope

The following terms and conditions apply to all orders via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity. 

The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to this.

2. Contractual partner, conclusion of contract

The purchase contract is concluded with Kühne Kaffee GmbH.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive another confirmation email.​

3. Terms of Delivery

Shipping costs are added to the stated product prices. You can find out more about the amount of shipping costs in the offers.

We only deliver by mail. Unfortunately, it is not possible to collect the goods yourself. 

You will receive a written shipping confirmation with the tracking number by email within 1-3 days.

4. Payment

The following payment methods are generally available in our shop:

Vorkasse 
If you select the payment method in advance, we will give you our bank details in a separate email and deliver the goods after receipt of payment.

Credit card
When placing the order, enter your credit card details. After your legitimation as the legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.

SEPA Direct Debit
By submitting the order, you give us a SEPA direct debit mandate. We will inform you about the date of the account debit (so-called pre-notification). By submitting the SEPA direct debit mandate, we ask our bank to initiate the payment transaction. The payment transaction will be carried out automatically and your account will be debited. The account will be debited before the goods are shipped. 

BillPay direct debit
After a successful address and credit check as part of the ordering process, you give the online provider BillPay a SEPA direct debit mandate when you submit the order and we assign our claim to BillPay. BillPay will inform you about the date of the account debit (so-called pre-notification). By submitting the direct debit mandate, BillPay asks your bank to initiate the payment transaction. The payment transaction will be carried out automatically and your account will be debited. The account will be debited before the goods are shipped. PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your access data and confirm the payment order to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterwards. PayPalPlus
As part of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. There you can enter your payment data, confirm the use of your data by PayPal and the payment instruction to PayPal.

If you have chosen the PayPal payment method, you must be registered there in order to be able to pay the invoice amount, or you must first register and authenticate yourself with your access data. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment order. You'll get more information during the ordering process.

If you have chosen the credit card payment method, you do not have to be registered with PayPal in order to be able to pay the invoice amount. The payment transaction will be carried out by your credit card company at the request of PayPal immediately after the payment order has been confirmed and after your legitimation as the legitimate cardholder, and your card will be debited. You'll get more information during the ordering process.

Immediately by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account activated for online banking, identify yourself accordingly and confirm the payment order to us. You'll get more information during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited. Google Pay
In order to be able to pay the invoice amount via Google Pay, you must be registered with the service provider Google, have activated the Google Pay function, identify yourself with your access data and confirm the payment order. Giropay 
After placing your order, you will be redirected to your bank's website. In order to be able to pay the invoice amount via Giropay, you must have a bank account activated for online banking, identify yourself accordingly and confirm the payment order to us. You'll get more information during the ordering process. The payment transaction will be carried out immediately afterwards and your account will be debited.

Apple Pay
In order to be able to pay the invoice amount via Apple Pay, you must use the "Safari" browser with which the service provider Apple is registered, have activated the Apple Pay function, identify yourself with your access data and confirm the payment order. Paydirekt 
After placing the order, you will be forwarded to the website of the online provider paydirekt. In order to be able to pay the invoice amount via paydirekt, you must have an activated online banking account for participation in paydirekt, be registered there or register first, identify yourself with your access data and confirm the payment order to us. Immediately after placing the order, we request paydirekt to initiate the payment transaction. The payment transaction is carried out automatically by paydirekt. Amazon Pay
In the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. In order to be able to complete the ordering process and pay the invoice amount via Amazon, you must be registered there or first register and authenticate yourself with your access data. There you can select the delivery address and payment method stored at Amazon, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected to our online shop, where you can complete the ordering process. Immediately after placing the order, we ask Amazon to initiate the payment transaction. Purchase on account via Klarna
In collaboration withKlarna AB, Sveavägen 46, Stockholm, Sweden, we offer purchase on account as a payment option. Please note that Klarna invoices are only available for consumers and that payment must be made to Klarna in each case. When purchasing on account with Klarna, you always get the goods first and you always have a payment period of 14 days. SEPA Direct Debit Plus 
If you have chosen the SEPA Direct Debit Plus payment method from the online provider Paymorrow, you do not have to be registered there in order to be able to pay the invoice amount. After a successful address and credit check as part of the ordering process, you issue the online provider Paymorrow with a SEPA direct debit mandate when you place the order and we assign our claim to Paymorrow. Paymorrow will inform you about the date of the account debit (so-called pre-notification). By submitting the direct debit mandate, Paymorrow requests your bank to initiate the payment transaction. The payment transaction will be carried out automatically and your account will be debited. The account will be debited after the cancellation period has expired, i.e. after the returns have been processed. Purchase on account via Paymorrow
In order to be able to pay the invoice amount via the online provider Paymorrow, you do not have to be registered there. After a successful address and credit check as part of the ordering process, we assign our claim to Paymorrow. In this case, you can only pay to Paymorrow with a debt-discharging effect. Purchase on account via BillPay 
In order to be able to pay the invoice amount via the online provider BillPay, you do not have to be registered there. After a successful address and credit check as part of the ordering process and submission of the order, we assign our claim to BillPay. In this case, you can only pay to BillPay with a debt-discharging effect. In addition to our terms and conditions, BillPay’s terms and conditions and data protection declaration apply to payment processing via BillPay. invoice
You pay the invoice amount after receipt of the goods and the invoice by bank transfer to our bank account. We reserve the right to offer purchase on account only after a successful credit check.

Alipay

5. Cancellation Policy​

right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. 

In order to exercise your right of withdrawal, you must send us (Kühne Kaffee GmbH, Marschnerstraße 23, 22081 Hamburg, Germany, support@kuhne Kaffee.de, phone: +49 40 88291574) a clear statement (e.g. a letter sent by post or email) about your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory. If you make use of this option, we will immediately (e.g. by e-mail) send you confirmation of receipt of such a revocation.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

 

Consequences of the revocation 

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract and the goods. For this repayment we use the same means of payment that you used in the original transaction; under no circumstances will you be charged for this repayment. 

You must return the undamaged and unused goods in the original packaging to us with the shipment tracking or hand them over to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

6. Retention of Title

The goods remain our property until full payment. 
The following also applies to entrepreneurs: We reserve title to the goods until all claims from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; You assign all claims arising from this resale to us in advance - regardless of whether the reserved goods are combined or mixed with a new item - in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations.

7. Damage in transit

The following applies to consumers: If goods are delivered with obvious transport damage, please report such errors to the deliverer as soon as possible and please contact us immediately. The omission of a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

The following applies to entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the freight forwarder, the carrier or the person or institution otherwise responsible for carrying out the shipment. The obligation to examine and give notice of defects regulated in Section 377 of the German Commercial Code (HGB) applies to merchants. If you omit the notification regulated there, the goods are deemed to have been approved, unless there is a defect that was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.

8. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you hereFind  . We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

9. Final Provisions

If you are an entrepreneur, German law applies to the exclusion ofUN sales law.

If you are a merchant within the meaning of the Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
